Permanent Total Disability Benefits Rewarded for Torn Rotator Cuff Injury
John Lumley injured his right shoulder while working for the City of Des Moines in 2000. He required surgery to repair a torn rotator cuff. After falling in a ditch, John re-injured his shoulder in 2002 while still employed by the city and required a second rotator cuff repair.
The city claimed John was not entitled to any disability benefits because the 2002 injury was identical to the earlier injury. Attorney Beth Flansburg took John's case to a hearing before a deputy workers' compensation commissioner, who awarded John permanent total disability benefits. The award was upheld on appeal and John will continue to receive weekly workers' compensation benefits for the rest of his natural life. At the time of the hearing, John was 35 years old.
